DREAM CLOUD PRIZE DRAW TERMS AND CONDITIONS


  1. This Prize Draw and these terms and conditions shall be governed by and construed in accordance with the laws of India and the parties agree to submit to the exclusive jurisdiction of the Courts of Kozhikode, Kerala. By entering the Prize Draw you are accepting these terms and conditions and agreeing to be bound by them.
  2. In the event of any dispute regarding these terms and conditions or otherwise relating to the Prize Draw, Dream Cloud Cart LLP’s decision shall be final.
  3. Only Users with a valid login id to the Dream Cloud Platform (“Member(s)”) that satisfies all the terms of the User Agreement are eligible to enter into our Prize Draws.
  4. Each product purchased from Dream Cloud platform by a Dream Cloud Member is awarded a single complimentary coupon per product to a specified Prize Draws.
  5. Employees of Dream Cloud Cart LLP and any individual directly or indirectly associated with employees or the operation of the Prize Draw are not eligible to enter the Prize Draw.
  6. The prize draw to announce the winner will be conducted only after selling all units of the same products. Dream Cloud Cart LLP retains the right to bring forward the draw date at any time.
  7. Winners of Prize Draws (“Winner(s)”) will be notified on the day the draw occurs. The names of Winners may also be announced in the social media platform as well as on the Dream Cloud website and our associated social (online) media profiles.
  8. The Dream Cloud Cart LLP retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available. Further, the Dream Cloud Cart LLP reserves the right to later amend, substitute or withdraw any element. The Prize is non-transferable and non-exchangeable and no cash alternative will be offered in any circumstance.
  9. Dream Cloud Cart LLP may, at its sole discretion, award other complementary prizes to the participants of specific Prize Draws based on various factors, including, but not limited to, the duration of which the Prize Draws has been live.
  10. By entering the Prize Draws, Winners confirm their agreement to take part in any associated publicity. The winner may be required to take part in promotional activity related to the Prize Draw and the winner shall participate in such activity on Dream Cloud Cart LLP’s reasonable request. All Dream Cloud Members consent to the use of their name in the event they are the Winner of any of the Prize Draws. This includes but is not limited to use of their name in the press media, social media platform, on the Dream Cloud Platform and on any social (online) media profile associated with us.
  11. All Dream Cloud Members consent that We have the right to use any and all digital records made by Us including, but not limited to, photographs, videos and call recordings of, the Prize, the Prize Draws, the winning phone call and the collection of the Prize, on the Platform and on any social (online) media profile associated with Us. These digital records may include imagery and/or voice recordings of the Winner and/or their name.
  12. Winners are responsible to pay all local taxes, income tax, custom duties, Insurance, Registration fees and any other form of expenses where applicable.
  13. Once a Prize is handed to/collected by the courier risk and responsibility will transfer to the Winner and we no longer hold claim nor responsibility for any damage/injury incurred in transit, or upon delivery.
  14. All Prizes represented on our Platform, will be awarded as displayed. Minor changes, including but not limited to color, may occur, however, no major changes, including but not limited to, specification, brand or value, will occur. The exact nature and specification of the Prize shall be at the sole discretion of the Dream Cloud Cart LLP.
  15. Dream Cloud Cart LLP is not responsible for any bank charges, including but not limited to processing fees from Your local bank.
  16. If any Winner is subsequently found ineligible to participate in the Prize Draws, Dream Cloud Cart LLP may at its sole discretion forfeit or reclaim the Prize or dispose of the same in such manner and to such person as Dream Cloud Cart LLP deem fit. All such decisions will be in line with the law of India.
  17. If any aspect of the Prize, is affected, amended, cancelled or postponed due to circumstances beyond Dream Cloud’s control, including but not limited to, travel cancellations, delays or interruptions due to acts of God, acts and advice of Governments, acts of war, epidemic, pandemic, natural disasters, weather, national catastrophes, advice against any travel by any Government or official authority for any reason (and/or the World Health Organization or any internationally recognized medical authority for any reason or an event of force majeure, the Dream Cloud Cart LLP and its agencies will not be responsible and the Prize will not be awarded and no additional compensation will be provided. No refunds or credit for changes are allowed.
  18. The Dream Cloud Cart LLP shall not be liable or responsible for errors in the administration or fulfillment of the Prize Draw, including without limitation mechanical, technical human, printing, distribution or production errors. The Dream Cloud Cart LLP shall be ultimately responsible for determining eligibility, in its sole discretion.
  19. The Dream Cloud Cart LLP will not be responsible for transport expenses or any expenses of a personal nature, in the collection of the Prize unless otherwise stated.
  20. The Dream Cloud Cart LLP will not be responsible for the inability of any Winner to utilize the Prize, for any reason whatsoever.
  21. The Dream Cloud Cart LLP will not be responsible for claims, damages, or expenses of any nature whatsoever for any loss, illness, bodily injury, including death, of or to any Winner and/or any third party during and/or in course of usage of any Prize or due to any defects in any Prize.
